Terms of Service

These Terms of Service ("Terms") govern your use of the Bookt Work website at booktwork.com (the "Site") and any services provided by Bookt Work ("we," "us," or "our"). By accessing this Site or engaging our services, you agree to these Terms.

1. Services

Bookt Work provides AI-powered lead capture and follow-up system installation services for owner-operated contractor businesses ("Services"). The specific scope, deliverables, timeline, and pricing for any engagement are defined in a separate written agreement between Bookt Work and the client.

2. Qualification Process

Submitting the "See If You Qualify" form on this Site does not constitute an agreement, contract, or guarantee of services. It initiates a review process to determine whether an engagement may be a good fit. Bookt Work reserves the right to decline any inquiry at its discretion.

3. Ownership of Deliverables

Upon receipt of full payment as specified in the client agreement, the client owns all automations, workflows, CRM configurations, and system components installed by Bookt Work. Bookt Work does not retain ongoing ownership of, access to, or control over client systems unless otherwise agreed in writing.

4. Performance Guarantee

Where a performance guarantee is included in a client agreement, it is limited to continued work at no additional cost until agreed benchmarks are met. It does not constitute a guarantee of revenue, leads, bookings, or business outcomes. The specific terms of any guarantee are defined in the written client agreement.

5. Payment

Payment terms are defined in the written client agreement. All fees are in the currency specified in that agreement. Bookt Work reserves the right to pause or discontinue work in the event of non-payment.

6. Intellectual Property

Bookt Work retains ownership of its proprietary methodologies, frameworks, and processes used to design and install client systems. The specific configurations, automations, and data built for a client are owned by that client upon full payment. Nothing in these Terms grants either party rights to the other's pre-existing intellectual property.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Bookt Work shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of this Site or the performance of Services. Our total liability for any claim arising out of a services engagement shall not exceed the fees paid by the client for that engagement.

8. Disclaimer of Warranties

This Site and its content are provided "as is" without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Third-Party Tools and Platforms

Our services may involve the configuration of third-party software platforms (such as CRM tools or SMS providers). Bookt Work is not responsible for the availability, pricing changes, or policy changes of third-party platforms. Clients are responsible for maintaining their own accounts and subscriptions with any third-party tools used in their system.

10. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of an engagement and not to disclose it to third parties without prior written consent, except as required by law.

11. Termination

Either party may terminate a services engagement by providing written notice as specified in the client agreement. Upon termination, the client retains ownership of all completed deliverables for which payment has been received. Bookt Work retains the right to receive payment for work completed up to the date of termination.

12. Governing Law

These Terms are governed by the laws of the province of Alberta, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms or a services engagement shall be resolved in the courts of Alberta, Canada.

13. Changes to These Terms

We may update these Terms from time to time. The date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
